The judicial investigation for the attack on Cristina Kirchner fell in the federal court No. 5 in charge of the judge Maria Eugenia Capuchetti and the prosecutor Carlos Rívolo. Federal judge María Eugenia Capuchetti took over as head of the court, replacing Norberto Oyarbide, in May 2019.

He had worked for two decades in the courts of Comodoro Py, where he was with Sergio Torres, current Minister of the Supreme Court of Justice of the Province of Buenos Aires, among others. Later he went to the Buenos Aires Public Ministry. She is attributed closeness to Daniel Angelici for being the daughter of former AFA Security Chief Carlos Capuchetti, and for ties to Martín Ocampo, a Buenos Aires legislator and former Minister of Justice and City Security. The election of Capuchetti was approved in the Senate with the vote of Cambiemos and federal Peronismwhile Kirchnerism voted against.

Since then, he has been responsible for causes of great political impact that reached Comodoro Py, from the denunciations of the illegal espionage of the macrismo, the corruption of Macri and the tolls, to the VIP vaccination of the Frente de Todos, through the serious criminalization of the social protest against the agreement with the IMF.

Protest against the IMF: On March 10 of this year, while the deputies were voting on the agreement with the IMF, there was a massive mobilization in front of Congress, which ended with the repression of a small group, and detainees, which with the passing of days increased along with the persecution of the social organizations that had participated. The next day, Cristina Fernández published that there were stones in her office and she denounced an attack. The Buenos Aires prosecutor’s office labeled the cause of “illicit association”, a figure created and used to persecute social and worker organizations, where human rights organizations and political organizations denounced the arrests without evidence. This is how the year began with a hate campaign, accompanied by the media, against those who have the least, against the sectors of the left, the workers and those who go out to fight. That continued with different spokespersons, political leaders, businessmen and journalists, in front of many demonstrations.

When the file was sent to Capuchetti, he ruled out the illicit association and released three detainees: Julián Lazarte, Jaru Alexander Rodríguez Carrero and Oscar Santillán. At the same time, he prosecuted six other protesters for aggravated harm and public intimidation, in a ruling in favor of the criminalization of social protest, and the investigation continues.

VIP vaccination: It began with the denunciation of the discretionary distribution of vaccines against the coronavirus, following the statements of journalist Horacio Verbitsky, who exposed how government officials had invited people close to them to be vaccinated in 2021. The case generated strong social questioning to the management of Alberto Fernández, who had to ask González García, former Minister of Health, to resign. Capuchetti initially filed the case for “no crime”, but the Federal Chamber ordered its reopening and investigation into the officials who made it possible.

Indalo Group: One of the first relevant rulings that Capuchetti signed was the dismissal of Cristóbal López and Fabián De Sousa in the case for the sale of the Indalo Group, and for an alleged millionaire scam to the AFIP. There he said that there were no maneuvers to sell the shares despite legal impediments. That ruling was key for López and De Sousa to request their freedom from the Federal Oral Court No. 3, in charge of the trial for the Oil Combustibles case.

“Toll Club”: In 2019, an alleged agreement between the national government and the concessionaire Autopistas del Sol (Ausol) began to be investigated, which would have meant “a profit of 499 million dollars” for this company. The fraud would have occurred when the concession contracts were extended despite the fact that the firms Ausol and Grupo Concesionario Oeste had not fulfilled their obligations. Judge Canicoba Corral had prosecuted the Minister of Transportation, Guillermo Dietrich, and the former head of the National Road Directorate, Javier Iguacel, accused of defrauding the State and negotiations incompatible with the public function. The Federal Chamber, with the signatures of judges Martín Irurzun and Leopoldo Bruglia, annulled that decision and ordered a new ruling to be issued. After the resignation of Canicoba Corral, the case passed into the hands of Capuchetti, who signed the “lack of merit” of the accused because, according to her, there were not enough elements in the case to prosecute them.

macrista judicial table: This case investigates Mauricio Macri and former officials of his government for pressuring judges and obtaining rulings in their favor, or “punishing” those who had not issued resolutions related to those official interests. They were denounced along with the former president, his former chief adviser José Torello, the former Minister of Justice Germán Garavano, the former Secretary General of the Presidency Pablo Clusellas, the lawyer Fabián Rodríguez Simón, the last attorney for the Treasury of Cambiemos, Bernardo Saravia Frías, the former head of the Federal Intelligence Agency Gustavo Arribas, the former president of the Boca club Daniel Angelici, the former chief of staff Marcos Peña and the former Minister of Labor Jorge Triaca. Illegal espionage AFI: By decision of the Cassation Chamber, Capuchetti was in charge of the case for espionage maneuvers that occurred during the government of Mauricio Macri, which was being processed in the federal courts of Lomas de Zamora. IMF Illegal Debt: The complaint was made by Claudio Lozano in 2019 against the Macri administration, based on reports on the “Stand By” agreement signed in 2018, by which the country was indebted for more than 50 million dollars.
