A former member of the Bundestag and judge was arrested during a raid on the Reich Citizens’ Scene. There was already a trial about Birgit Malsack-Winkemann.

25 suspected members and supporters of a terrorist organization were arrested in a nationwide raid early Wednesday morning. As Federal Minister of Justice Marco Buschmann (FDP) and the Federal Prosecutor’s Office announced, it should be about so-called Reich citizens. They are said to have planned an overthrow of the political system in Germany.

The ex-AfD MP Malsack-Winkemann is said to be accused

The Berlin judge and former AfD member of the Bundestag Birgit Malsack-Winkemann is one of the suspects who was arrested in the nationwide raid against the so-called Reich Citizens’ Scene. “We will exhaust all instruments to remove the accused completely from the judiciary,” said Berlin’s Senator for Justice Lena Kreck (left). After her time in the Bundestag, the state of Berlin wanted to prevent Malsack-Winkemann’s return to the judge’s seat – and failed in court.

The Berlin Senator for Justice Lena Kreck (left) argued in the proceedings, which ended in mid-October 2022, that the former AfD member of the Bundestag Malsack-Winkemann had to be retired because of her political speeches in the Bundestag and other statements. However, the service court for judges rejected the application of the Senate Justice Administration. According to the Basic Law, the speeches in the Bundestag are free and protected and should not lead to any official sanctions, it said. They are therefore not usable in the proceedings. Justice Senator Kreck said after the arrest: “The investigations are to be seen, but apparently the Senate administration was right in its assessment.”

Exclusionary and false claims about refugees?

Some of Malsack-Winkemann’s statements on the Internet, especially about the Corona laws and the US election and once about refugees, did not show any right-wing extremist attitudes in the October proceedings. That’s what the court judge said. Nor could photos of her with other AfD politicians prove the proximity to the former so-called wing of the AfD, which was considered extremist. He sees no evidence to assume that Malsack-Winkemann’s independent work as a judge has been severely impaired.

The Senate Department of Justice and Senator Kreck had accused Malsack-Winkemann of exclusionary and false claims about refugees and applied for her retirement because she was no longer impartial as a judge.
